UGV sued out a reconsideration of application for a special permit for Skhidne-Golubivske by SSGSU
The JSC UkrGasVydobuvannya (UGV) appealed to the District Administrative Court of Kyiv with an administrative claim to the State Service for Geology and Subsoil of Ukraine (SSGSU), requesting to outlaw the Order №290 of the SSGSU refusing to grant a 20-year special permit for geological study of oil and gas subsoil, including research and development of fields, with subsequent production of oil and gas in the Skhidne-Golubivske oil and gas acreage in the Novomoskovsk district of Dnipropetrovsk region. The UGV also asks the court to oblige the SSGSU to issue the special permit on the Skhidne-Golubivske oil and gas acreage to the UGV.
The claims were substantiated by the fact that in 2016 the UGV applied to the SSGSU with a request for a special permit for subsoil use without holding an auction. As of the time of the application, the UGV was fully entitled to obtain such a permission at that time ‘s legislation, but did not make any decision in accordance with the established procedure and within the timeframe due for consideration and decision on the UGV’s application.
The administrative lawsuit was partially satisfied by the decision of the district court. The Order №290 of the SSGU was declared unlawful and revoked. The SSGSU was obliged to reconsider the UGV’s application for the special permit on the for the Skhidne-Golubivske oil and gas acreage, taking into account the conclusions of the court. The rest of the claims of the UGV were dismissed by the court.
