TSM GROUP demands court to exclude Energoatom from companies against which enforcement actions are suspended
TSM GROUP has filed a lawsuit with the Kyiv District Administrative Court against the Ministry of Strategic Industries of Ukraine, requesting to cancel the order “On inclusion of Joint-Stock Company “National Atomic Power Generating Company “Energoatom” in the list of enterprises that are debtors in enforcement proceedings, enforcement actions against which are suspended during martial law”.
The court has opened simplified proceedings in the administrative case.
As stated in the court materials, the corporation "TSM GROUP" asks the court to:
- Declare unlawful and cancel the order of the Ministry of Strategic Industries of Ukraine No. 95 dated 02.08.2024 "On the inclusion of the Joint Stock Company "National Atomic Power Generating Company "Energoatom" in the list of enterprises that are debtors in enforcement proceedings, the execution of executive actions for which is suspended during the period of martial law";
- Obligate the Ministry of Strategic Industries of Ukraine to exclude the Joint Stock Company "National Atomic Power Generating Company "Energoatom" from the list of enterprises that are debtors in enforcement proceedings, the execution of executive actions for which is suspended during the period of martial law.
As previously reported, the Ministry of Strategic Industries by its order dated August 2 included NNEGC Energoatom in the list of enterprises subject to a moratorium on debt collection in court until the end of martial law. To participate in the case as a third party who does not declare independent claims regarding the subject of the dispute on the defendant's side - Joint-Stock Company "Energoatom".
