People's Deputies registered the draft law on Energoatom NNEC JSC

People's Deputies of Ukraine have registered a draft law on the Energoatom NNEC Joint-Stock Company.

A respective draft law was received by the Verkhovna Rada on September 22.

"The draft law defines the procedure for the formation and functioning of Energoatom NNEC JSC 100% of which is owned by the state, and establishes the procedure for the formation of the authorized capital of the company, the functioning of the company after its creation, restrictions related to ensuring the preservation of corporate rights of the state, the property of nuclear power plants, nuclear materials, and facilities designed for the management of radioactive waste, exclusively for the Company, to ensure economic security and protect the interests of the state," the explanatory note reads.

According to the document, the company's shares acquired by the state due to the company's formation are not subject to privatization. The draft law defines the procedure for company establishment.

"The procedure for company formation provides for: ... a full inventory of the property of Energoatom NNEC (except for the property that is part of and/or is located on facilities in the areas of military (combat) operations, temporarily occupied territories, or areas surrounded (blocked) due to the armed aggression of the Russian Federation against Ukraine, which for the inventory provided for in this part are accounted for based on the results of the last available inventory), compiling of a consolidated inventory report, a list of non-current assets subject to independent assessment, for transfer of the authorized capital of the company, considering the features defined by this law, and approval by the founder;

At the same time, it is allowed to use data of the inventory, performed within a period not exceeding 12 months before the date of the founder's decision on transformation", the bill reads.

The initiators of the bill are Ostap Shypailo, Andriy Herus, Serhiy Nahornyak, Anna Skorokhod, Oleksandr Horobets, Dmytro Pryputen, Anatoly Kostyukh, Yuri Kamelchuk, Volodymyr Moroz, Victoria Hryb, Yevhen Pyvovarov, Maksym Yefymov.

Before that, in August, the Cabinet of Ministers of Ukraine already submitted to the Parliament a draft law "On the specifics of the formation of Energoatom NNEC JSC", which also defined the procedure for creating a joint-stock nuclear energy company.

However, on September 20, the Anti-Corruption Policy Committee issued findings, according to which the draft law of Ukraine "On the specifics of the formation of Energoatom National Nuclear Energy Company JSC" (Register. No. 7650) does not meet the requirements of the anti-corruption laws in certain provisions.
