DTEK Zahidenergo won a lawsuit against Ukrenergo for UAH 435 million

The Supreme Court confirmed the decision of the commercial and appellate courts regarding the collection of UAH 435 million in debt for balancing services from Ukrenergo NPC in favor of DTEK Zahidenergo.

The relevant resolution of the Supreme Court as part of the panel of judges of the Commercial Court of Cassation was adopted on March 2, 2023.

"The cassation appeal of the Private Joint Stock Company "National Power Company "Ukrenergo" shall be dismissed. The decision of the Commercial Court of the city of Kyiv dated 07/26/2022 and the decision of the Northern Commercial Court of Appeal dated 11/14/2022 in case No. 910/18611/21 shall be left unchanged," the resolution reads.

The court collected from NPC Ukrenergo in favor of JSC DTEK Zahidenergo UAH 435,678,090.19 principal debt, UAH 1,029,136.31 penalty, UAH 845,865.46 3% annual, UAH 539,654.33 inflationary losses , as well as UAH 546,694.65 in court fees. DTEK's claims were based on non-payment for balancing electricity in August 2021 - January 2022.

At the beginning of the court case, the amount of the principal debt amounted to UAH 693 million, but it was later reduced, after partial payment by NPC "Ukrenergo".
