Ukrnaftoburinnya won in the court case versus Ukrgaz
The Commercial Court of Kyiv applied to Ukrnaftoburinnya (hereinafter - the plaintiff) with a claim against Ukrgaz LLC (hereinafter referred to as the defendant) asking to recover 5.9 million UAH.
On May 20, 2016, Ukrnaftoburinnya (seller) and the Ukrgaz signed an agreement on the sale and purchase of gas. The planned volume of gas supply in May 2016 amounted to 824,033 thousand cubic meters for the total amount of UAH 4.7 million (excluding the cost of transportation through Ukrtransgaz pipelines).
In May 2016, Ukrnaftoburinnya transferred Ukrgaz gas to a total amount of UAH 4.7 million, which is confirmed by the signed act of acceptance-transmission of gas of 31.05.2016.
Evidence of payment of debt is not provided.
The court was resolved to satisfy the claim of Ukrnaftoburinnya in collecting 4.7 million UAH of the principal debt. Accordingly, after conducting the verification of the calculation, the court decided to satisfy the claim to collect UAH 200 thousand of inflation losses from Ukrgaz, UAH 57 thousand – 3 % annual interest, UAH 47.4 thousand – 1% fine, UAH 236.9 thousand – 5% fine, and UAH 88.2 thousand court fees.
