UGV loses Cabinet the court case over Varvynske field

Ukrgasvydobuvannya JSC lost a lawsuit against the Cabinet of Ministers over the Varvynske field. The oil and gas site remained with the US Ukrainian Energy Company. This is evidenced by the decision of the Sixth Kyiv Administrative Court of Appeal dated September 29.

According to court materials, Ukrgasvydobuvannya tried to challenge the result of the competition of the Interdepartmental Commission, which concluded a hydrocarbon production sharing agreement with the Ukrainian Energy for Varvynska area for 50 years. The Cabinet of Ministers approved the results of the competition by Resolution No. 507-p dated July 5, 2019.

The plaintiff, in particular, demanded to recognize the victory of the American company in the competition as “groundless” and oblige the Interdepartmental Commission to reconsider the applications of the bidders. As indicated in the court’s decision, the Commission scored 184 points to the proposal of Ukrainian Energy, while the application of Ukrgasvydobuvannya gained 169 points.

The official reason for this decision was the advantage of the American company “in terms of financial support for the proposed work program on the subsurface area, efficiency in environmental protection and experience in the exploration and production of hydrocarbons.”
