Ukrnaftoburinnia sued debts from Fortuna Oil for gas condensate
The Commercial Court of Kherson region filed a lawsuit of the Extraction Company called Ukrnaftoburinnia JSC versus Fortuna Oil Ltd. for recovering the debts.
The court found that on January 24, 2018, the parties made an agreement on the sale and purchase of gas condensate. Ukrnaftoburinnia pledged to transfer 30 tons of gas condensate of Sakhalinske oil and gas condensate field production to Fortuna Oil at the price of UAH 23,600 per ton, with a total value of UAH 708 thousand (+/- 10 per cent). The transfer of the goods was carried out on the FCA terms - CGPP Devon PJSC of Sakhalinske field, Krasnokutsky district of Kharkiv region. Thus, on January 25, 2018, the parties signed an act of receipt-transmission, which recorded the fact of the transfer of 32.105 tons for UAH 757.7 thousand.
However, Fortuna Oil made only a partial payment, namely: UAH 653 thousand according to payment order dated January 25, 2018. Thus, at the time of the consideration of the case, the Defendant had got an indebtedness of UAH 104.7 thousand.
Having examined the materials of the case, the court decided to satisfy the claim in full and recover the following from Fortuna Oil in favour of VK Ukrnaftoburinnia: UAH 104.7 thousand of the main debt, and UAH 81.8 thousand of penalties. In addition, the Respondent has been to reimburse UAH 2.8 thousand of a court fee.
