Ukrhydroenergo demands UAH 5 million from SE Guaranteed Buyer indebted under PSO

The hydropower generating company PJSC Ukrhydroenergo is demanding a fine of UAH 5 million from the SE Guaranteed Buyer for non-fulfillment of obligations to pay for electricity under the public special obligation (PSO) for electricity needs of household consumers.

The Commercial Court of Kyiv opened proceedings in the case, as published in the Unified Register of Court Decisions on July 15, 2021. The PJSC Ukrhydroenergo appealed to the Commercial Court of Kyiv with a claim to the SE Guaranteed Buyer to recover UAH 5060139.29, of which: UAH 1546839.33 fine, UAH 3513299.96 fine," said in the resolution.

As stated in the court materials, in substantiation of the claim, the PJSC Ukrhydroenergo referred to the failure by the SE Guaranteed Buyer fully and timely pay for the purchase of PSO electricity supplied by the PJSC Ukrhydroenergo to cover the needs of the Ukrainian household consumers, as stated in the Purchase Contract from May 28, 2020, and the Settlement Agreement of October 12, 2020, on debt restructuring.

According to data obtained by ExPro, on May 28, 2020, the PJSC Ukrhydroenergo sold 124240 MWh of base, peak, and weekend peak loads to the SE Guaranteed Buyer under the PSO mechanism at the fixed price of 673.76 UAH/MWh for consumption schedules of June 2021.
