Kirovograd Court has recovered funds from the debtors of Energia-95

The Economic Court of Kirovograd region filed a lawsuit from Energia-95 LLC Versus Yur-Gaz LLC (the founder and director is Oleksandr Dzyuba) regarding the collection of funds.
The court found that on September 25, 2018 a contract for the sale and purchase of gas had been concluded between the Plaintiff (Seller) and the Defendant (Buyer). Under this agreement the volume of gas in October 2018 comprises 300 thousand cubic meters. The agreement establishes that the total cost of the resource is UAH 3.9 million. It is evident from the available acts of receiving and transmission that the Defendant has acceptedthe specified volume. However, Yur-Gaz partially paid for gas in the amount of UAH 1.36 million, which is confirmed by payment orders. Accordingly, at the time of the consideration of the case, the Defendant had indebtedness in the amount of UAH 2.53 million.
After investigating the materials of the case, the court decided to satisfy the claim in full and recover the following from Yur-Gaz in favour of Energia-95: UAH 2.53 million of main debt, UAH 178.8 thousand of a penalty, and 3 per cent per annum – UAH 4.9 thousand, and the court fee which is UAH 40.9 thousand.
The court established that on October 2, 2018, the purchase and sale agreement for 400 thousand cubic meters of gas for the total amount of UAH 5.12 million was made between the Plaintiff (Seller) and the Defendant - A2-GAZ (Buyer). The indicated volume was accepted by the Defendant, but A2-GAZ only paid for gas in a part that equals to the amount of UAH 1.82 million, which is confirmed by the payment order dated October 22, 2018. At the time of the proceedings, the Defendant had an outstanding debt of UAH 3.3 million.
The court decided to satisfy the abovementioned claim in full: to recover the following from A2-GAZ in favour of Energy-95: UAH 3.3 million of the main debt, UAH 245.9 thousand of a fine, UAH 20.5 thousand – 3 per cent of annual interest, as well asUAH 53.4 thousand of the court fee.
