Court returned Navigator Komplekt’s lawsuit challenging UGV’s victory in PSA competition

On March 3, the Kyiv District Court returned a lawsuit filed by Navigator Komplekt LLC, which challenged the results of the competition for the conclusion of the hydrocarbon sharing agreement, namely the determination of Ukrgasvydobuvannya JSC the winner of the competition for sharing of hydrocarbons to be produced on Berestyanska area.

On February 4, the company filed to the District Administrative Court of Kyiv a relevant lawsuit against the Cabinet of Ministers, the Ministry of Energy and the Environment of Ukraine, the Interdepartmental Commission on the Arrangement and Implementation of Production Sharing Agreements.

However, it was left without motion. The court expected from the plaintiff proofs of the validity of the reasons set for skipping the six-month filing term set in Part 2 of Article 122 of the CAS of Ukraine. As a result, the Court decided that the reasons for skipping the term were irrelevant and returned the statement to the claimant.

We remind that in July 2019 the Cabinet of Ministers has determined the winners of PSA competitions for 9 areas.

Last year, UGV has challenged the results of a competition on Varvynska area, won by Ukrainian Energy LLC (USA, Texas) (currently considered by the first instance court), and UNB disputed the results for Zinkivska area, won by the DTEK structure (currently considered by the Supreme Court).

The beneficiary controller of Navigator Komplekt LLC in URLE is Oleksiy Stepchenko; ten individuals own the shares of the company. In 1999, the company worked with Ukrnafta PJSC under Joint Venture Agreement at the Kachanivske field.
